Terms of Use & Sale

These terms govern use of the Helena B. Scott website and, when enabled, purchases of goods, digital content and services. Product pages, booking descriptions, written proposals and checkout information may contain additional terms specific to an order. Nothing in these terms excludes or restricts a right that cannot lawfully be excluded, including statutory consumer rights.

About the website operator

The website is operated by Helena B. Scott, an independent sole trader established in Ireland. Enquiries may be made through the contact page. Required trader, price, delivery, cancellation and payment information will be presented before a paid online order can be placed.

Using this website

You may browse the public website for lawful personal, educational and professional purposes. You must not interfere with the website, attempt unauthorised access, misuse an account, introduce malicious code, circumvent access controls, harvest personal data or use the site in a way that infringes another person’s rights.

You are responsible for keeping account credentials confidential and for activity carried out through your account. Please report suspected unauthorised access promptly.

Research, educational & historical content

The website presents original and continuing historical, archaeological, cultural, symbolic and psychical research. Interpretations may develop as new sources, field evidence or scholarship emerge. Dates, event details, availability and external information may also change. Reasonable care is taken, but public website content is provided for general information and education and is not a substitute for a commissioned professional assessment.

Nothing on the site authorises archaeological excavation, intervention in a protected monument, handling of restricted archival material or any activity requiring a licence, owner consent or statutory permission. Users and commissioning bodies remain responsible for obtaining appropriate specialist, legal and regulatory advice.

Intellectual property & permitted use

Unless otherwise credited, the website’s written content, original research, teaching material, photographs, artwork, recordings, databases, selection and arrangement, branding and design are owned by or licensed to Helena B. Scott and are protected by copyright and other applicable rights. Historic images and third-party material remain subject to their stated credits, licences and rights.

You may quote brief passages for genuine criticism, review or scholarship where the law permits and proper attribution is provided. You may not reproduce substantial content, republish, resell, distribute, remove credits or use material commercially without prior written permission.

Except where law expressly provides otherwise, automated scraping, systematic extraction, creation of substitute archives, text-and-data mining, model training, dataset creation, embeddings or ingestion of the website’s content into an artificial-intelligence or machine-learning system requires prior written permission.

Accounts, private libraries & digital content

An account may be required to deliver or retain free resources, purchased downloads, recordings or private-reader content. Access is personal to the named account holder and may not be shared, transferred, resold or made public unless a different licence is expressly stated.

Account, security, delivery and access messages are service communications. Creating an account or claiming a resource does not by itself subscribe the account holder to marketing; newsletter signup is handled separately as explained in the Privacy Policy.

Digital books, excerpts, recordings and course materials are supplied for personal use. Technical requirements and the period or form of access will be stated with the relevant item. Consumer remedies for digital content or services remain unaffected.

Orders, prices & payment

Prices will be shown in euro unless otherwise stated. Applicable taxes and any delivery charge collected by Helena will be displayed before checkout. Physical items delivered outside Ireland may also attract destination-country import VAT, customs duty, handling or clearance charges imposed by public authorities or the carrier. Unless checkout expressly states that those destination charges are included, they are not included in the item price or delivery charge and are the recipient’s responsibility. Placing an order is an offer to purchase; a contract is formed only when the order is accepted or the service is expressly confirmed. Obvious pricing or availability errors may be corrected before acceptance.

Secure card payments are not currently active. If Stripe checkout is enabled, payment will be processed by Stripe and the customer will receive an order confirmation in a durable form. The payment button will clearly indicate when placing the order creates an obligation to pay.

Delivery, performance & availability

Estimated delivery, digital access, event dates, consultation arrangements and service timeframes will be stated with the relevant item or proposal. Unless expressly guaranteed, dates are estimates and may be affected by circumstances outside reasonable control. If a material delay or cancellation occurs, the customer will be informed and the remedies required by law will be offered.

Cancellation, withdrawal & refunds

Where Irish or EU consumer law provides a right to withdraw from an online contract, the applicable period, method and model cancellation information will be supplied before purchase. The usual withdrawal period for many distance contracts is 14 days, but exceptions apply.

  • If you ask for a service to begin during a withdrawal period, you may be asked to make an express request and may be responsible for the proportion already performed if you later cancel.
  • A right to withdraw may end after a service has been fully performed where the legally required request and acknowledgement were given.
  • Immediate access to paid digital content may require express consent to begin supply and acknowledgement that the withdrawal right will be lost once supply begins.
  • Dated leisure events and personalised goods or services may be subject to statutory exceptions.

Consultations and individual appointments: a consultation cancelled with at least seven clear days’ notice may be refunded or rescheduled. Where a customer has a statutory right of withdrawal, that right remains unaffected. If the customer expressly requests preparatory work or performance to begin during the statutory withdrawal period and subsequently withdraws, Helena may charge a proportionate amount for services already supplied. After the statutory withdrawal period, cancellations made with fewer than seven clear days’ notice and non-attendance are non-refundable. A booking may be rescheduled no more than twice. After the second rescheduling, the appointment must be attended on the agreed date or the fee will be forfeited, except where mandatory consumer rights require otherwise. One transfer or credit may be offered in exceptional circumstances at Helena’s discretion. If Helena cancels, the customer will be offered a suitable alternative appointment or a full refund.

Fixed-date online talks, courses and live events sold by Helena: bookings for a live event supplied on a specified date or during a specified period are non-refundable from the time of booking, except where mandatory consumer rights apply or the event is cancelled or materially rescheduled by Helena. A transfer or credit may be offered in exceptional circumstances at Helena’s discretion. If Helena cancels or materially reschedules the event, the customer will be offered a suitable alternative, transfer or full refund. Any immediate access to a recording, download or other paid digital content will be handled separately and, where required, the customer’s express consent and acknowledgement will be obtained before supply begins. Where a partner organisation is the seller, that organisation’s booking and cancellation terms apply.

Product-specific cancellation, rescheduling, refund, delivery and access terms will be shown before purchase. These terms do not reduce rights relating to faulty goods, non-conforming digital content or services not supplied with reasonable care and skill. Questions or cancellation notices may be sent through the contact page.

Consultations, mentorship & wellbeing services

Consultations, mentorship, lectures and related services are educational, reflective, spiritual and/or research-based according to the pathway selected. They are not medical care, psychotherapy, psychiatric treatment, legal advice, financial advice or emergency support, and no diagnosis, cure, specific result, historical finding or personal outcome is guaranteed.

You remain responsible for your own decisions and wellbeing. Do not delay or replace qualified medical, mental-health, legal or emergency assistance because of website content or a consultation. If you are in immediate danger or crisis, contact the appropriate emergency or health service in your location.

Helena may decline or pause work that falls outside the agreed scope, requires a regulated professional, creates a conflict of interest, involves abusive conduct or cannot be undertaken safely or ethically. Where consumer law requires a remedy, that right remains unaffected.

Lectures, events, commissions & institutional work

The scope, fee, expenses, rights, recording permissions, cancellation terms, deliverables and timetable for a commissioned lecture, research project, heritage service, media appearance or digital system will be set out in the relevant written agreement. Website descriptions are invitations to enquire and do not themselves create a commission.

External services & links

The website links to independent services including Patreon, Substack, social-media platforms, booksellers, venues and professional organisations. Their content, availability, privacy practices and transactions are governed by their own terms. A link is not a guarantee or endorsement of every statement or service on an external site.

Liability

Nothing in these terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, breach of non-excludable consumer rights or any other liability that cannot lawfully be limited. Subject to those protections, Helena is not responsible for loss caused by unlawful use of the site, reliance on general informational content outside its stated purpose, failures of third-party services or events outside reasonable control.

For business users only, liability connected with a paid service will be addressed in the relevant written agreement. No provision is intended to create an unfair term or deprive a consumer of a mandatory remedy.

Governing law, complaints & changes

These terms are governed by the laws of Ireland. Consumers retain any mandatory protections and rights to bring proceedings available under the law of their country of residence. Concerns should first be raised through the contact page so that they can be addressed directly.

These terms may be updated to reflect new services or legal requirements. The version applying to an order is the version made available when that order is placed, together with its product-specific information.
